DECISION

The approval of the «Order for the provision of social assistance to low-income Azerbaijanis living abroad»

To apply the Law of the Republic of Azerbaijan "On Amendments to the Law of the Republic of Azerbaijan "On State Policy Related to Azerbaijanis Living Abroad" of 29 November 2016, number 426-VQD, and enforcement of paragraph 1.3 of the Decree of the President of the Republic of Azerbaijan of 11 January 2017 number 1188 "On the amendment of the Decree of the President of the Republic of Azerbaijan "On the application of the Law of the Republic of Azerbaijan "On the State Policy related to Azerbaijanis living abroad" of 23 February 2003 number 859" The Cabinet of Ministers of the Republic of Azerbaijan decides:
1. To approve the "Procedure for providing social assistance to low-income Azerbaijanis living abroad" (attached).
2. This decision will enter into force on 1 January 2021.

The provision of social assistance to low-income Azerbaijanis living abroad

1. Main provisions

1.1. This Order has been prepared in accordance with article 6.2 of the Law of the Republic of Azerbaijan «On State Policy towards Azerbaijanis Living Abroad» (hereinafter - the Law) and defines the mechanism for providing social assistance to low-income Azerbaijanis, living abroad.

1.2. Social assistance for low-income Azerbaijanis living abroad is provided in accordance with the generally accepted principles of international law and the national legislation of the foreign State concerned.

2. Basic concepts

2.1. The basic concepts used in this Order express the following values:

2.1.1. a low-income Azerbaijani living abroad is an Azerbaijani, as defined by article 1 of the Act, whose average monthly income is less than the average monthly wage of the foreign State in which he resides and has resided in that country for more than 182 (one hundred and eighty-two days);

2.1.2. social assistance for low-income Azerbaijanis living abroad - one-off material assistance aimed at improving their social status.

3. Circumstances for social assistance application

3.1. Low-income Azerbaijanis living abroad are entitled to receive social assistance from the Republic of Azerbaijan in the following cases:

3.1.1. In the presence of Azerbaijani persons under the age of 18 who have lost both parents under guardianship;

3.1.2. In the event of damage caused during emergencies, war and hostilities, and failure to receive the necessary insurance and other means of reparation in the country of residence;

3.1.3. If it is necessary to transport the body of a deceased close relative to the Republic of Azerbaijan.

4. Application for social assistance

4.1. Applicants for social assistance may use the electronic service «Accepting applications for social assistance to poor Azerbaijanis living abroad» on the portal «E-Government» or in the section «State services» on the official website of the Fund for Support of the Azerbaijani Diaspora (hereinafter referred to as the Fund), submitting the application in electronic form.

4.1.1. supporting documents on the circumstances that gave rise to the receipt of social assistance and the applicants;

4.1.2. document confirming registration at the place of residence.

4.2. The application sent electronically is immediately registered and within 1 (one) working day the information is sent to the applicant’s e-mail and mobile phone. The date on which information is sent is the date on which social assistance is requested.

4.3. The authenticity of documents prepared by State bodies of a foreign State submitted by low-income Azerbaijanis living abroad in order to receive social assistance must be confirmed by apostille or legalization. When documents are drawn up in a foreign language, a translation into Azerbaijani is added.

5. Appointment or refusal of social assistance

5.1. The Fund examines them and decides on applications for social assistance in cases referred to in sub-paragraph 3.1.1 of this Order within 25 (twenty-five) working days in cases referred to in sub-paragraph 3.1.2 within 5 (five) Working days, and in cases provided for in sub-paragraph 3.1.3 within 3 (three) working days from the date of receipt.

5.2. Social assistance is denied in the following cases:

5.2.1. if there are discrepancies in the information reflected in the documents referred to in paragraph 4.1 of this Order, or if the information provided is incomplete or incorrect;

5.2.2. if the person receives social assistance from the relevant State bodies of the country of residence.

5.3. In the event of a decision to grant social assistance, the amount and duration of the assistance, and in the event of a decision not to grant it, a copy of the decision, together with the reasons for the refusal, is sent to the applicant on the same day.

5.4. A decision to provide or refuse social assistance may be appealed in accordance with the Law of the Republic of Azerbaijan «On Administrative Procedure» through administrative or judicial procedure.

6. Payment of social assistance

6.1. Social assistance is paid within 3 (three) working days from the date of the decision on the allocation of social assistance.

6.2. Social assistance shall be paid in the cases provided for in sub-paragraphs 3.1.1 and 3.1.2 of this Order by a transfer to the bank account of the applicant, and in the cases provided for in sub-paragraph 3.1.3 by a transfer to the account of the authority, responsible for the delivery of the body to the Republic of Azerbaijan.

6.3. In the event of a delay in the payment of social assistance, the applicant may inform the Fund and the State Committee on Work with Diaspora of the Republic of Azerbaijan.

7. The upper limit of social assistance

7.1. The upper limit of social assistance is set at 3,000 (three thousand) manat.

8. Monitoring of social assistance

8.1. The State Committee on Work with Diaspora of the Republic of Azerbaijan monitors the provision of social assistance.
